Competition Rules

ORGANIZATION AND ADMINISTRATION

Design Competitions on udforu.com are organised and administered by UD4U, L3C as UD4U™.

UD4U™ reserves its right to assign any judges, agents or other authorised administrator to administer it’s competitions, including making any decision or exercising any such right at it’s discretion.

ELIGIBILITY

UD4U™ Competitions are open to anyone aged 18 and over.

By entering UD4U™ Competitions, any and all entrants, participants, and submissions agree in full to these Terms and Conditions and as referred “herein”.

Employees of UD4U™, members of the judging panel and their employees, associates, partners, or relatives are prohibited from entering the competition. They are however, encouraged to submit ideas for an unpaid special mention but can not win or be part of the formal competition.

SUBMISSION

Entrants may either make a submission individually or as a team (4 people max.).

Competition entrants are prohibited from selling, assigning or transferring any of their submission rights to a third party.

Student entrants will be required to prove their status for any student only competitions and the same would be true for professional (licensed) only competitions should the submission be selected as one of the winning entrants.

All Submissions must strictly conform to any Terms and Conditions and the Rules and Guidelines set by our UD4U™ Competition Brief.

Once the final submissions are sent, no additional edits, or changes can be made. Upon receipt of the final submission each participant will receive a confirmation email notification within two business days.

By entering the competition, the entrant acknowledges and accepts that all aspects of any submission narrative, description, details, images, illustration and animation may be used for publicity purposes by UD4U™.

PERSONAL INFORMATION

Any personal information submitted by entrants or participants to UD4U™ will only be used when necessary and only disclosed to third parties for the purposes of running the Competition.

OWNERSHIP AND COPYRIGHT

The ownership of copyright in the work of all submissions will be in accordance with the Copyright Act 1976, which implies the copyright rests with the author and allows for its "fair use".

No Entrants or participants shall receive, or be entitled to receive, any payment, in any form, for submissions, or for granting UD4U™ any right herein, other than for being selected as one of the winning the competition entries.

Subject to any limitation herein, any design, drawings, etc. accompanying any entry or submission remains the property of the entrant and may be used for his/her/their own purpose.

UD4U™ shall treat an entry or submission as being eligible to enter the Competition under United States Copyright law.

Entrants are solely responsible for protecting the intellectual property of any submission to UD4U™ competitions.

COMPETITION DISQUALIFICATION

Submissions which do not meet or comply with the submission guidelines, or are found to contain identifying signs or marks that may, in any way, contribute to identifying the entrant, shall be disqualified and UD4U™ shall be under no obligation to notify the Entrant or Participant of the disqualified entry or submission. All Submissions after the closing date for a particular competition will be automatically disqualified.

COMPETITION CANCELLATION/WITHDRAWAL

UD4U™ reserves the right to cancel, suspend, or alter the rules at any time, if deemed necessary in its opinion, and if circumstances arise outside of its control.

COMPENSATION

Any Compensation will be handled by UD4U™.

WINNER SELECTION/JUDGE'S DECISION

UD4U™’s determination of any winning entry or submission through its panel of judges is final.

In the event that a selected winning entry cannot be accepted, received or is ineligible for the prize for any reason, the prize shall be awarded to the next highest rated entry from the top short-listed or remaining entries that meet the winning requirement.

UD4U™’s association with the competition judges does not imply any legal association, affiliation, contract or partnership in any way shape or form.

COMPETITION INTEGRIRY

UD4U™ makes every attempt to scrupulously protect the integrity of its competitions by:

Generating a Unique Entrant Registration Number by which each submission received will be administered, organized, processed and evaluated. This means that the digital board received will be stored under their registration numbers, with the complementary information kept in a separate file.

Enforcing the rules that besides the registration number, all illustrations or images accompanying any submission shall be void of any marks, logos, symbols or sign that may identify its author or source.

Any infringement of these rules will lead to immediate disqualification.

The jury or judging panel will only be made aware of the entrants identities after the evaluation stage and winners are selected.

PRIZES

Prizes are awarded from the total money received in registration fees, with the maximum award for each category being what is advertised for each competition. Should the total amount of money raised from registration fees be less than the published total for prizes, UD4U™ reserves the right to amend the award totals that will be given based upon each categories percentage of the total money that it was to receive.

For example; A competition was published as having $5,000 in prizes, with 1st = $2500 (50% of total), 2nd = $1250 (25% of total), 3rd = $750 (15% of total), and 5 honorable mentions = $100 each (10% of total, 2% each). However only $4,000 was raised in registration fees, then prizes would be as follows: 1st = $2000 (50%), 2nd = $1000 (25%), 3rd = $600 (15%), and 5 honorable mentions = $80 each (10%, 2% each)

UD4U™ also retains the right to add additional awards, should additional funds be available.

Unless explicitly stated in a competition brief, no competition hosted by UD4U™ has any intention of being built or becoming a real project. Even though sites we choose are real and may have actual development efforts happening in relation to them, does not mean that the competitions hosted by UD4U™ have any relationship with those real world efforts and all entrants accept that the competition is for hypothetical design ideas only.

All winning participants who are awarded more than $600 are required to fill out the proper IRS Documents and supply UD4U™ with their legal name, Social Security Number, permanent address, and any other information requested by UD4U™.

All prize money will be dispersed via PayPal and all participants must already have or create a PayPal account to be eligible to receive the prize money.

UD4U™ sends out a single email to each winning participant informing them what prize they have won and also the necessary personal information, documents, and PayPal information that is required to deliver the prize money to the participant.

Participants have 30 days from the date that the winning email is sent to return all of the required information to UD4U™ and claim the prize money. Any participants who do not return the required information to UD4U™, within those 30 days, subsequently surrender their portion of the prize money.

PUBLICATION

UD4U™ reserves the right to publish such material, in whole or in part, and use it in any way it sees fit in connection with this website, the company, or its competition(s), without permission of the entrant or payment for such use.

REGISTRATION FEE AND ASSOCIATED COST

There is a registration fee for Competitions on the website and all costs and disbursements incurred by entrants in preparing a submission or entry are the sole responsibility of the entrant.
All registration fees are non-refundable and non-transferable once registration is made.

GOVERNANCE

These rules of UD4U™ Competitions are governed by the laws of the United State of America and the State of Illinois.

PUBLICITY AND PROMOTITON

Winners agree to and shall, upon request, with reasonable notice, participate in:

-Publicity or promotional activity surrounding the Competition such as interviews, personally or otherwise. Each opportunity shall be taken on merit and the Entrant or participant, shall have the right to decline any such opportunity.

-Any imposed government regulations or economic sanctions by the United States that prohibit monetary transfer to a Winner’s country of residence shall result in the prize money not being awarded to the entrant and at UD4U™’s discretion may award it to the next highest ranked entry, however will mention the original winning entry in its list of winners.

LICENSE

By submitting an entry to the Competition, you the “Entrant” provide UD4U™ with a limited, non-exclusive, sub-licensable, worldwide, royalty-free license (but not the obligation), which license is effective in perpetuity, for the duration of the competition/Project and until the end of the judging of the competition, to use, copy, modify, translate and/or adapt, distribute, publicly display by any means and in any media and create derivative works of, and copy, distribute and publicly display such derivative works of your entry solely in connection with the inclusion of your entry in activities related to, and the promotion of, the competition and the particular project, without any further notice or remuneration to you.

The rights shall be applied to all existing or future media, and in particular all physical, optical, magnetic, analogical, digital and electronic media, including media such as hardcopies, CD-ROMs, DVD-ROMs, hard disks, computers and servers, the Internet, all private or public telecommunication networks, by cable, satellite, radio networks, etc.

By submitting your entry to the Competition you also give UD4U™ a non-exclusive, worldwide, royalty free, irrevocable license in perpetuity to display and archive your entry on the UD4U™ website, www.udforu.com ("Website"), on UD4U™’s Facebook, Twitter or other social networking / media pages / websites owned or run by UD4U, L3C, in relation to the Competition or project. Any credits will be with the name you supply to the Competition.

UD4U™ shall make reasonable efforts to display appropriate and customary credit lines on any Submissions displayed or otherwise featured in such media, however shall have no affirmative duty to do so.

LIABILITY

Entrant agrees to release, indemnify, defend any party from any liability, any claim for damages, and/or law suit for or by reason of the mentioned submission as a result of any submission, revision, alteration or similar thereof.
The entrants also acknowledge and agree and therefore covenant not to sue or make any claim against any party related to an entrant’s submission or any individual participating or involved in the Competition in any way whatsoever, or any use thereof, and therefore:

a) Under no circumstances shall or can the Entrant be entitled to any award for any loss or any damages, which include attorneys’ fees.

b) Any dispute, claim and legal action arising from or connected with this Competition, or any prizes awarded or potentially awarded therein, shall be resolved without resort to any form of legal action or class action.

c) Should an entrant choose to bring a claim against UD4U™ or it’s agents the entrant shall pay UD4U™ or any party’s reasonable attorneys’ fees and its legal costs arising from the claim should it fail.

d) Nothing herein will constitute a waiver of the entrants or participants legal rights or any rights any party may have to take against the entrant or participant.

UD4U™ shall not be liable for any lawsuit or claim against any of it’s judges or selector panel emanating from their professional conduct or otherwise.
Unless clearly stated, all Competitions are design concept only and do not imply in any way, an intention for the proposals to be constructed or built.

AMENDMENTS

UD4U™ reserves the right to amend these Terms and Conditions at any time without notice.
